Existing law establishes a workers' compensation system to compensate an employee for injuries sustained in the course of his or her employment. Chapters 635 and 639 of the Statutes of 2003 (AB 227 and SB 228) will make changes to the workers' compensation system effective January 1, 2004. This bill would repeal and renumber various provisions pertaining to the division. The bill would recast certain of these provisions relating to the procedures to be followed by physicians in evaluating the existence and extent of permanent impairment and limitations resulting from an injury. This bill contains other related provisions and other existing laws.

This bill would make various findings and declarations regarding the existing workers' compensation system and would declare the Legislature's intent to amend the program to address those concerns.

Existing workers' compensation law generally requires employers to secure the payment of workers' compensation, including medical treatment, for injuries incurred by their employees that arise out of, or in the course of, employment. Existing law establishes liability for compensation against an employer for the injury or death of an employee, including instances where the injury is proximately caused by the employment and where the injury is not caused by the commission of a felony or a misdemeanor by the injured employee for which he or she has been convicted. This bill would revise these circumstances that establish liability for an employer to include, instead, where the employment is the predominant cause of the injury compared to all other causes combined, and where the injury is not caused by the commission of a criminal act by the injured employee for which he or she has been convicted.

Existing law prohibits an employer from exacting or receiving from any employee any contribution, or making or taking any deduction from the earnings of any employee, either directly or indirectly, to cover any part of the cost of compensation under the workers' compensation program. This bill would provide that the use of workers' compensation costs in the calculation of profits for purposes of an employee bonus program is not a deduction from the earnings of an employee within the meaning of this provision.
